DMCA & Copyright Policy

PRV.CAM ("PRV.CAM", "we", "our" or "us") respects intellectual property rights and expects all users, creators, applicants, visitors, partners and service providers to do the same.

This DMCA & Copyright Policy ("Policy") establishes procedures for reporting alleged copyright infringement, responding to intellectual property complaints and addressing disputes concerning content, materials, media, trademarks, branding, images, videos, text, software, databases and other protected works that may be associated with PRV.CAM services.

This Policy is intended to support compliance with applicable copyright laws, including the United States Digital Millennium Copyright Act ("DMCA"), where applicable, as well as other intellectual property laws and regulations that may apply in various jurisdictions.

Platform Role

PRV.CAM operates as a technology, administration, marketing and creator support platform.

PRV.CAM does not generally create, author, produce, direct, supervise or control creator-generated content and does not guarantee the legality, ownership, licensing status or intellectual property compliance of materials submitted, published, transmitted or otherwise made available by independent users or creators.

Users and creators remain solely responsible for ensuring that they possess all necessary rights, permissions, licenses and authorizations required to use, publish, distribute, display or otherwise exploit any content associated with their activities.

Copyright Ownership Responsibility

Each user and creator represents and warrants that they own or possess all necessary rights to any content, materials, media, images, videos, audio recordings, text, graphics, trademarks or other intellectual property submitted, published, distributed or otherwise made available through activities connected with PRV.CAM.

Users may not upload, publish, distribute, display, transmit or otherwise utilize content that infringes or misappropriates the intellectual property rights of any third party.

Users assume full legal responsibility for all content and intellectual property used in connection with their activities.

Copyright Infringement Reports

If you believe in good faith that material associated with PRV.CAM infringes your copyright or other intellectual property rights, you may submit a written infringement notification through the official communication channels published by PRV.CAM.

To facilitate review, infringement notifications should include sufficient information to identify the allegedly infringed work, the allegedly infringing material, the basis of the claim and information reasonably necessary to allow investigation of the complaint.

Submission of a complaint does not guarantee removal, restriction, enforcement action or any particular outcome.

Investigation Process

PRV.CAM reserves the unrestricted right, but not the obligation, to investigate copyright complaints, intellectual property claims, ownership disputes, trademark disputes, impersonation claims, licensing concerns or related matters.

PRV.CAM may request additional documentation, ownership records, licenses, registrations, releases, contracts, court orders, declarations or other evidence deemed reasonably necessary to evaluate a complaint.

Failure to provide requested information may result in dismissal, closure or suspension of review.

Enforcement Measures

Where PRV.CAM determines, in its sole discretion, that content may present intellectual property concerns, PRV.CAM reserves the unrestricted right to remove content, restrict access, suspend accounts, terminate services, preserve records, limit functionality or take any other action deemed appropriate.

PRV.CAM may take such action without prior notice where legally permitted or operationally necessary.

Nothing in this Policy shall be interpreted as creating an obligation to remove content, terminate accounts or resolve disputes in any particular manner.

Counter-Notifications

Where appropriate and legally permitted, PRV.CAM may allow affected parties to submit counter-notifications, ownership claims, authorization evidence or other information relevant to a dispute.

PRV.CAM reserves the sole discretion to determine whether additional review, restoration, continued restriction or other action is appropriate.

PRV.CAM is not obligated to restore content, reinstate accounts or reverse enforcement actions.

Trademark and Brand Complaints

This Policy may also apply to complaints involving trademarks, trade names, service marks, logos, branding elements, publicity rights, image rights and similar intellectual property interests.

PRV.CAM reserves the right to evaluate such complaints under procedures it considers appropriate.

Repeat Infringers

PRV.CAM reserves the unrestricted right to suspend, restrict or terminate access for users or creators who are the subject of repeated intellectual property complaints, repeated infringement allegations or repeated violations of intellectual property rights.

PRV.CAM shall have sole discretion in determining what constitutes repeated infringement or repeated violations.

No Adjudication of Ownership

PRV.CAM is not a court, arbitrator, intellectual property office or governmental authority and does not undertake responsibility for making legally binding determinations regarding ownership, authorship, licensing status, contractual rights, fair use, jurisdictional questions or competing claims of entitlement.

Users acknowledge that intellectual property disputes may require resolution by courts, arbitrators, regulators or other competent authorities.

Good Faith Requirement

Individuals submitting complaints, notices, counter-notices or other intellectual property claims must do so in good faith.

Knowingly submitting false, misleading, fraudulent or abusive claims may result in account restrictions, denial of future submissions, termination of services or other actions deemed appropriate by PRV.CAM.

Third-Party Platforms and Services

PRV.CAM may interact with, support or integrate with third-party platforms, providers and services.

PRV.CAM is not responsible for intellectual property enforcement procedures, policies, decisions, actions or omissions of third-party services.

Users remain responsible for complying with all intellectual property requirements imposed by such third parties.

No Monitoring Obligation

PRV.CAM may, but is under no obligation to, monitor, review, inspect, audit or evaluate content, accounts, communications, materials or activities for intellectual property compliance.

The absence of review, monitoring, investigation or enforcement shall not be interpreted as approval, authorization, endorsement or confirmation of legal compliance.

Reservation of Rights

PRV.CAM reserves all rights available under applicable law, contract, policy and operational procedure.

Nothing in this Policy limits PRV.CAM's ability to take actions necessary to protect its legal, operational, reputational, security or business interests.

Limitation of Liability

To the maximum extent permitted by applicable law, PRV.CAM, its owners, directors, officers, employees, contractors, affiliates and service providers shall not be liable for content removals, content retention, account suspensions, account terminations, enforcement decisions, investigation outcomes, intellectual property disputes, ownership disputes, licensing disputes, legal proceedings or any direct, indirect, incidental, consequential, special, exemplary or punitive damages arising from or related to intellectual property matters.

PRV.CAM expressly disclaims responsibility for independently created, uploaded, published or distributed content submitted by users or creators.

Indemnification

Users and creators agree to defend, indemnify and hold harmless PRV.CAM, its owners, directors, officers, employees, contractors, affiliates, successors and service providers from and against any claims, lawsuits, investigations, liabilities, damages, penalties, judgments, settlements, costs and expenses, including legal fees, arising from or related to intellectual property disputes, infringement allegations, licensing issues, ownership claims, trademark claims or content-related legal matters associated with their activities.

Policy Updates

PRV.CAM reserves the right to modify, amend, replace or update this DMCA & Copyright Policy at any time. Continued use of PRV.CAM services following publication of revised terms constitutes acceptance of the updated Policy.
